Mom moved to Arizona in violation of a domicile restriction. The jury found that the domicile restriction should remain in full force and if mom wanted to remaim primary she would have to move back to Harris and contiguous counties.

This was an original divorce case where the Mother wanted to move back to New Jersey with the children. The parties agreed to JMC prior to Trial. The jury trial lasted 7 days.

Verdict: 10-2 verdict in favor of Mom with the geographical restriction limited to Harris County or New Jersey.

  1. Was the birthmother defrauded by the agency when she signed her voluntary relinquishment?
  2. Should the parental rights of the birthmother be terminiated?
  3. Is termination fo the mother's parental rights in the best interest of the children?

This was a termination case wherein the prospective adoptive parents intervened to terminate both biological mother and father. Father's parental rights were terminated for failure to file a paternity suit or request affirmative relief after being served. Mother filed to revoke her affidavit based on fraudulent inducement.

Verdict:11-1 verdict in favor of termination of the birthmother's parental rights

Issue - Termination of dad's rights.

Verdict - The jury said that although there was clear and convincing evidence that Keith Titus did not support the child within his means for a period of one year ending within six months of the date case was brought, they did not believe that their was clear and convincing evidence that Keith Titus' parental rights should be terminated. Termination Denied.

Issue: Kids were over 18 years old and Dad brought suit against mom for missed visitation with the children. Mom claimed she did everything she could to make children exercise visitation but they did not want to see their dad.

Verdict: Jury found for Mom. Jury granted attorneys fees against Dad for bringing the suit.

The jury issues in this case were (1) the right to determine the primary residence of the child and (2) whether or not a geographic restriction should be put in place limiting where the primary residence could be established by the person selected in issue (1) above. Mom wanted to move to Holland. The jury granted mom the right to determine the primary residence and permitted her to determine the primary residence without restriction so she could move Holland.

Modification suit of JMC where father was Primary Joint Managing Conservator and mother sought modification. Jury found for the mother.


Attorney Fees and Malpractice

In the Matter of the Marriage of William Clay and Amy Clay and in the interest of Hayden Adam Clay, cause number ________ in the 246th (December 8, 1999)
Attorney for Duff was Sheelah Wooten and Greg Enos for Wife

Attorneys fees and malpractice action. Jury found $9,000.00 was reasonable and necessary fees earned by Johnette Duff for representation of Amy Clay. Jury also found that Duff breached her fiduciary duty to Clay in divorce case. Jury also found $500.00 would compensate Clay for that breach for mental anguish and/or loss of use of any funds wrongfully taken from client. Jury did not find any intentional or gross negligence in the breach. Jury found attorney acted negligently in breach. Jury found attorney guilty of conversion of a check payable to Clay in amount of $3,000.00 but found no damages, no malice, no exemplary damages.

In the Interest of Austin Michael Verret, cause number 1997-44984 in the 246th (December 16, 1999)

Modification suit from January 7, 1998 order where jury found that the right to determine the primary residence of the child should be modified such that Miriam Flores (mother) was awarded that right.


Torts in the Divorce Suit

In the matter of the marriage of Charles Fred Xeller and Madeline Theresa Xeller and in the Interest of Charles Joseph Xeller and Amanda Ariel Xeller, cause number 95-39292 in the 311th (January 28, 2000)
Attorney for Wife- Bill De La Garza; Attorney for Husband - John Nichols

Jury found Charles committed assault on Madeline. They also found intentional infliction of severe emotional distress and that $500,000.00 for physical pain and mental anguish and an additional $500,000.00 in exemplary damages.

In the Matter of the Marriage of Teresa Renee McNabb and Matthew Cephas McNabb and in the interest of Devin Tyler McNabb, Ian Martin McNabb and Cameron Wallace McNabb, cause number 99-19496 in the 246th (February 8, 2000)
Attorney for mother was Ron Marsh and Attorney for dad Barry Radcliffe

Jury found both parents should be joint managing conservators and named the mother as the parent with the right to determine the primary residence of the children.
